Transfer of property after death of first owner

thank you respected expert for your valuable comments and suggestion."my father and mother jointly purchased flat which is registered in their name jointly but before taking possession my father died. there are last 3 query.
1) is it compulsory to get legal heir certificate to execute release deed in favour of my mother?
2) what is procedure to get release deed executed?
3)is local municipal corporation office where we pay property tax for our property the tehsildar/ taluk office?

Dear Client,

It is compulsory to get legal heir certificate from revenue officials. It is also compulsory to get Release deed executed in favour of your mother releasing or relinquishing your rights of your share in the property in question. Release deed means you declare in a document t that you don't have any right title and interest in the property in question your releasing or relinquishing all YOUR rights in the property in question in favour of your mother. It should be sufficiently stamped and registered and along with your signature and your mother's signature it has two witness signatures, who have seen you executing the release deed.Municipal corporation OFFICE HAS NOTHING TO DO WITH YOUR RELEASE DEED.
