Misplaced of envelope by courier company

Dear Sir/Madam

I couriered an envelope having mobile phone worth Rs. 17000 aprrox.. Courier company has not delivered this envelope and misplaced it.

Now, they are not responding and don't take responsibility at all.

it is their basic duty to deliver the envelope.

What are the legal remedy available to me in this case?

Please guide me

Did you declare that the packet contains mobile phone? In case youbdid not, then in that case you will get normal compensation. Certainly not rs.17000/- even if you approach consumer forum.

Consult your Local Good advocate and Proceed Legally.There are Chances that you could get not only the Reimbursement You could even claim for damages and mental harassment Caused by their negligence.

For further guidance to the author or the persons with similar problems, while tendering the cover for shipment, at the time of booking the courier company will ask for declaration of contents and some times worth of the contents. If the contents are costly, the shipment can be insured. Further, one can create evidence of non-delivery by tracking the shipment in the courier company's website. With all this one can go to consumer forum on the grounds of deficiency of service and get relief.

The question is:
(1)whether querist could hope to get compensation for the mobile in case he had not declared the same?
(2) whether the courier companies licence can be got cancelled for non-delivery of the packet in question?

According to my knowledge :
1. No. If has not declared the contents and value. On the basis on such declaration, the courier company may insist for insurance of the shipment. If it is insured then only the insured amount will be paid.
2. No unless the customer proves that the courier company is negligent in handling the shipment.

By the time the experts were discussing the issue (with exchanges too), the author has updated that his actual problem has been solved, hence the query remains resolved.
