Consideration of salary in 125 maintenance case

SIR, MY WIFE FILED THE MAINTENANCE ALLOWANCE CASE U/S 125 CRPC. I WANT TO KNOW THAT HOW THE COURT DECIDE ABOUT THE SALARY OF A PERSON AND IS THE ALLOWANCE IS COUNTED AS SALARY. HOW MUCH IT WILL BE IN MY CASE , AS I AM RECEIVING RS. 17000/- CASH IN HAND AND GIVING THE LOAN TO BANK OF RS. 4000/- TAKEN FOR SISTER MARRIAGE , RS. 2300/- FORM MONTHLY MEDICINE AND CHECKUP FOR MOTHER,RS. 800/- PAYING FOR AS LOAN REFUND TAKEN FROM THE DEPRATMENT AND 1500/- RS. IS THE TRANSPORT ALLOWANCE IN SHOWN IN MY SALARY. THEM HOW MUCH MY SALRY WILL BE CONSIDRED, FOR MAINTENENCE ALLOWENCE.

court generally awards 1/3rd of your income as maintenance . since you are earning Rs 17,000 a month court can award Rs 5,000 as maintenance .

I am Surprised that the Expert who had corrected him in this thread( Not the Senior Expert Mr.V.R.Shroff)had appreciated the same post and had Recommended him in the Post of Thread"Party in Case".He could recommend I am no one to interfere but why the sudden change in this Thread with in a hour Please.

It can be upto 1/3 of 17000 + 4000 + 800 + 1500 or say 7,500/-
However, all depend upon facts, circumstances, court and pleadings.
