paying guest staying without permission

We stay in a building with 8 flats of which 4 are of one person. On d first floor they have there office and give other flat to someone who has again subrented it and useing as paying guest. 3rd floor they have 2 flats which were rented out to families. And 2nd and 4 th flats are owed by individual's. Now resently the family on 3rd floor above us movedout and now they have again given it to the same person who is running pg on the 1st floor for which rest of us opposed. We gave them a time of a month to shift but they didn't. Now staying below them we face problem as they start playing in middle of the night or god goes what they do to bang the floor and we are up in d middle of the night. Moreover I am living with people with heart problem. I am worried. Now i need to know What are the actions I can take against them as my family is suffering the most and other families are even in support.

Though you can not stop keeping PG in the flats but you have certainly right to stop the nuisance.

Against midnight loud music you can complaint with Police.

To stop other regular nuisances you can initiate proceeding u/s 133 crpc.

was society permission taken before keeping PGs in flat? was police verification done ?

What do you mean by "Paying Guest". Paying Guest is one who lives with the family for purpose of accommodation and food. Who is hosting them? Owners of the flat?

From your query as I understand, these 2 flats were rented out to bachelors and they are creating nuisance.

You have only the way - talk to them and tell them other occupants are suffering because of the nuisance and unless it is stopped, necessary steps will be taken. the society of he Manager who is looking after the affairs of all the flats for common problems, can summon the owners of these two flats and explain the nuisance that is being created by the occupants of their flats. Ask the owners to take steps for vacating them. If they are adamant you can as well complain to the police for the midnight nuisance.

Try to have solution by mutual understanding and talking with them, if they do not stop nuisance, lodge complaint with the police.

I agree with the experts, just a dialoge with the residents will work perfectly, however, if donot,call police.

The bachelors are tend to enjoy their weekends or their bachelor life, of course they are to be in a limit that their activities do not create nuisance or trouble neighbors. Most of such residents are well educated and coming from a good family background, so a cordial talks with them will help to improve the situation, try that or say what is your exact problem that are envious that the owner is earning a good income by letting the flats out to bachelors
