not accepting my resignation

Hi i am working in a reputed bpo company since 1 yr .. thre has been some family issues in which my father is been ill an iam required to go back to hometown .. I wanted to resign frm the company but when I spoke to my manger abut the same he denied accptin my resignation sayin tht he will acpt in dec 2014 only its very urgent fr me to be thre in my home town .. sir plese advice...

If you really have to be at your home town on genuine reasons (not an excuse to leave the company by one reason or other) then you can definitely take leave (even if it means without pay), then rejoin before december, and ask the manager to accept the resignation in December, 2014 as he has planned/said to you.

1. How much time, efforts, money and/or other resources (available to you) do you save in writing your query in SMS language? Please avoid.
2. I agree with the expert advise of Mr. Anirudh.
3. Submit your resignation to the manager and take care of father, who need your presence more than your money/job consequently away from home/him.
4.Let the employer may deduct the amount of notice period/bond money.
5. However, donot forget to surrender (on receip)all documents/I D Card/keys/ passwords etc. held with you on behalf of the company, which are the property of employer.

When you are intending to submit resignation on grounds of parents sickness, why your manager is not accepting your resignation? Is there any bond from your side? If he wishes to accept the resignation only due to shortage of staff, submit the proof of sickness and take leave. Handover the things of company stating that the leave period is uncertain which depends upon the health of your father.

If you have executed a bond or you have some hidden agenda come with full facts.

1. Resignation can be without permission and notice. However employee should tender reasonable notice, and affirm in notice of resignation that NO tasks are pending at his end and routine duties be assigned that can be completed within and upto last day in office i.e. dated…………………………and to whom he/she should handover the charge against acknowledgment on the spot, within and upto last date in office………………..and acknowledgment of notice/resignation, acceptance of resignation, correct FnF statement for verification and acceptance, payment of FnF dues by bank DD only, service certificate, relieving letter, PF number/account slips of each year of service, salary slip of each month of service, ESIC card, NOC/NDC be supplied within and upto last date in office……………


2. You have a very valid reason for leave. Self/parents/family/motherland/nation comes first………………….and employer would be last than these. Your father is sick and just mention sickness of father……………………………NO employer can demand no employee is under any obligation to supply any medical certificate of the father………………………..however as a thorough gentleman you may write a gentle communication preferably by letter thru redg. post or atleast from your personal email id ( addressed to good offices of appointing authority/MD………………….preferably or the manger to start with and escalate to good offices later) that on dated…………………..you have represented in person in office to Mr/Ms…………………………designation………………dept…………….and appraised him on sickness of your father and need of your being by the side of your father immediately…………………….to your shock it was declined…………………………………( if situation warrants it you may mention under the shock of situation you had offered to resign so that you can be by the side of your father…………………….and Mr…………………….stated that resignation shall not be accepted before dated…………………………thus disallowing you to be by the side of your sick father…………………………….)………………………and you seek the intervention of good offices to grant you the approval of leave from dated………………….to dated……………………and that the leave application is attached in original and reply be supplied to you by Redg. post at the address given in leave application (preferably your native address where you shall be). Mention it clearly that you shall not be able to take phone calls and emails hence letter thru Redg. post at the given address be sent. Each employee is not authorized to write on letterhead hence some sensible/competent person shall write to you and you shall not be chased by line managers/HR personnel.


3. If you have signed a BOND then mention it in this thread…………………………..and also clarify the BOND was created in lieu of what extra ordinary favor by company e.g training etc………………and whether you were given a copy of the bond or not?

4. You should build favorable written record.

5. BPO’s are covered by (Name of the state) Shops and Commercial establishments Act, standing orders…………………………..and you should be covered as “workman’ as in ID Act, and as ‘Employee’ as in Shops and Commercial establishments Act. Leave approval/declinature should be supplied to employee in writing in 3 days.

6. Employee should submit leave application in writing under proper acknowledgment.
