Damage of dignity

Hi,

Village sarpanch and few others gave a press statement on July 19th 2014 in the Sakshi daily newspaper saying that my brother and myself got patts for a tank from the revenue department in 1956, which is 20 years before we born. They are trying to show us as a land grabbers and they are trying to say as we got this land illegally by managing the revenue department.

In fact government granted patta in 1967 to our grandfather, who was a freedom fighter and the same land was transferred to us as per his veelunama. Thos land is in our position till now. Government acquired 0.24 acres in 1986 to make an irrigation channel, and paid compensation for the same.

In 1970, courts were given a clear judgement and they did not question anything about this land allotment and court recorded the reasons for the tank closure which was done 10 years before the assignment to our grandfather.

As my grandfather was a freedom fighter and my father was a social worker and we are leading our life with dignity and respect and carry forwarding our grandfather's and our father's dignity and respect.

Our dignity and trust got damaged due to the false news paper statement which was given by responsible elected leader and others.

As mentioned in the news paper statement they damaged our crop too. Due to that we lost 3 lakhs value crop.

As most of the public may believe the news paper statement as correct they may get an impression that we grabbed the government land illegally, due to this none of the labor coming to work on our fields from that village which is causing further loss to us.

I would like to sue him for the compensation for damaging our dignity and our family dignity and respect and another 3 lakhs for the property damage.

Please advice how to approach on this.

Lodge a police complaint for damaging the crops. Issue legal notice to the Editor for wrong publication.

Contact, consult and engage a local lawyer who may be able to proceed in a professional manner after going through the records available with you, understanding and analysing the facts and legal proposition on the issue, since there are various factors/ exemptions involved in filing case for compensation of damages due to alleged defamation

you have two options-
1) register FIR for defamation; and/or
2) file suit for damages

Also issue notice to concerned parties, to show cause, WHY DEFAMATION DAMAGES shd not be demanded.
File Civil suit for damages
File criminal case to punish them

Manage to get the Sakshi news paper to publish ur version of the case to stave off the bad impression created by the wrong news given by the sarpanch. If u are particular to get compensation for the loss of the crops and u have evidence to prove that specified persons had caused the loss u may proceed to issue legal notices and pursue the matter in the court as suggested by the experts above.
