Criminal f.i.r against my nri son

Dear Sir/Madam,

My land related one civil case going between me and my neighbour in the court since 2012. Recently I called him for compromise, but he asked large amount to withdraw case. I have no source to pay large amount.

My son is presently working in Singapore who comes to India for his next year marriage on 45 days leave. My neighbour is arranging some area person to file any of the criminal FIR against my son. I came to know this news recently, he is taking steps to revenge my family indirectly. So, please give your guidance the following my doubt.

1) Incase if my neighbour file criminal FIR against my son, will affect my son to leave Singapore as his usual time?
2) Can my son apply for any advance bail warrant?
3) Can Police seize my son’s passport against criminal FIR?
4) How I save my son against this fraud FIR?
5) Please provide all your helpful guidance this issues.

Madame Marimuttu,

1. I can understand that there is a civil case going on. In matter of civil case police cannot record any F.I.R.

2. If your son has not done any criminal action then why should you be afraid that your neighbor will file criminal complaint against him ?

3. Please share more background details of the civil case and any other issues that you think can lead to filing of criminal complaint against your son.

If FIR is registered against your son, he can get anticipatory bail.

But, we can guide you properly, only on knowing the nature of complaint.
