Divorce after separation

I would like to get some information regarding divorce in Christian marriage.

I was married in May 2009. In 2011 December I got separated from my husband.
The reason for separating from him is his cruelty. I have been staying alone since then. I tried contacting his family to know his whereabouts so that can discuss about divorce by mutual consent but they either don't respond or give lame excuses saying they don't know where he is.

Now on what grounds can I apply for divorce and how long it would take

Cruelty and long separation are both grounds available with you. Last known address should be mentioned in the petition and later on notice may be got published in a news-paper.

contested divorce cases take 5 years to be disposed of . by mutual consent you can get divorce in 7 months . search in lCi database for lawyers in karnataka

You can visit local court compound and find some good lawyer dealing in divorce cases. Also search LCI database.

It shall be better to search local lawyer having good standing in the field. Divorce petition generally take a period of about 3 years.

You may present a petition to the District Court or to the High Court, praying that your marriage may be dissolved by a decree of divorce under the provisions of Indian Divorce Act, 1869section 10 on the grounds of cruelty coupled with desertion without reasonable cause for two years or upwards. The time limit on a contest divorce cannot be predicted, better consult a local lawyer and proceed as per his advise.
