Filing of cheating case

I have sent legal demand notice to my wife in a cheque bounce case. I was cheated of my money by my brother in law with the help of my wife. I am confident that they will not make any payment. So I am preparing to file a case after 15 days.
My lawyer has suggested me to file two cases. One case of cheque bounce in the court and another FIR for 420 at the local police station. But my relative who is also a lawyer has suggested me to file a complaint case under sec 420 read with sec 138.
Which is legally correct option. And if both are legal than which option will be better for my case. Pls guide me.
