False case u/sec 420 i.p.c. cheating quash or discharge

(Querist) 09 June 2014 This query is : Resolved
Sir,

I got 2/3rd share in my mother's property and decree holder of partition suit. My sister got 1/3rd share. Due to my sister cunningness and greediness created a forged unregistered relinquishment deeds claiming she paid me substantial consideration amount for relinquishments. My sister filed private case under Sec 420 i.p.c police arrested me on the basis of xerox copy of the relinquishment deed and completed investigation and filed the chargesheet with only interested witness and not submitted all the documents in the court and I have not received all the case related papers for my defence. I pleaded not guilty. My sister has not produced any documentary evidence of the transaction. Since the case is fake and taken on revenge I would like to go for a quash or discharge.

Can I go for a quash after cognisance of the offence by the court.Do I have a right to file discharge petition when called for examination. What is the proper time for discharge and quash.

I would be grateful if I am informed the legal procedures.

Thanking you,
