Shipboard allowance

what is the meaning of Fixed shipboard allowance and variable shipboard allowances?? whether those allowances are to be included or excluded while calculating income in Case for compensation under motor vehicles Act??

deceased was working as Oiler on a ship and his salary certificate shows certain amount paid under the head Fixed shipboard allowance and Variable shipboard allowance...
please answer the query and also cite the source of knowledge.

thanks respected experts for replying... advice is to read book... which book to read..I plead ignorance... i could not lay my hands on any book or judgment which states whether fixed shipboard allowance and variable shipboard allowance is be included in the income of the deceased while calculating compensation under motor vehicles Act...

Don't forget, yours is not a legal problem and the members here can be expected to solve only legal problems. Different organisations have their own set of adminsistrative rules and procedures, which only the people of the organisation know.

You should not expect the members to know about the volumes of administrative rules and instructions of each and every department/ organisation throughout India.

Needless to mention, if you being directly related to your organisation do not know what are the rules or whom to contact for going through such rules, how you can expect the totally unrelated persons to know the rules of your own organisation.

well... i am sorry to say this but i am amused to hear that query raised by me is not a legal problem... Compensation under motor vehicles act and what should be the criteria of arriving at the same is not a legal query.. then what is a legal query?

and i have not asked rules and regulations of any organisation... its as simple as whether HRA should be included in the income of the deceased while calculating the Compensation his dependants would be entitled.. the latest judgment would say yes, it is to be included... whether travelling expenses are to be included or not.. the answer would be no...
if you have not understood the question... thats fine... if you do not know the answer it is fine too....

Mr. Tushar,

If as a lawyer you are unaware of the meaning of shipboard allowance, I wonder, how you expect the others to know its meaning. How would you justify asking a meaning of a term not to be an academic query?

Further, if you don't discuss the actual legal problem with it background of the case and merely ask whether the shipboard allowance is to be included or excluded in compensation, how would you like to justify your query not to be an academic query? Merely asking for a question like a student whether to include or not the allowance for the purpose of compensation does not make that a legal problem.

In fact, instead of asking for such an irrelevant academic query, you could well have asked your client, for what purpose the allowance is granted and whether that is merely to compensate his own expenses or as an income.
