Darkhast case

(Querist) 29 May 2013 This query is : Resolved
A court gave its judgement and issued a decree in the year 1988. The said matter was then forwarded to the Maharashtra Revenue Department as a 'darkhast'.
I wish to know what exactly a 'darkhast' means?
Is there a time limit for finishing a darkhast file?
Can defendant after a gap of 25 years appeal against the said decree? (case was in lower court)
What steps can be taken by decree holder in case Revenue Department has lost the darkhast file (which is still under compliance) during execution of the decree?

Dharkhast is nothing but a execution of a decree. period of limitation is 12 years for the execution
V K (Querist) 29 May 2013
what is period of limitation?
Raj Kumar Makkad (Expert) 29 May 2013
Darkhast in Marathi refers to application seeking mutation. It means that an application was moved before Talathi to effect the mutation on the basis of that decree which is still pending due to loss of that Darkhast. The period of limitation to get execution of that decree is 12 years but if it is established that the loss of application on the part of the department then such delay can definitely be condoned.

The appeal against that decree cannot be filed at such belated stage.

Makkad ji, Darkhast in Marathi does not refers to application seeking mutation. The word Darkhast used in our Maharashtra State or as the word is used in Marathi language refers to an application/ petition filed for execution of a decree of a civil court. The application filed for the execution of decree of a civil court is called a Darkhast.
