Bail procedure after mediation is failed in up

(Querist) 13 March 2013 This query is : Resolved
Dear Experts,

Please guide me about the bail procedure in UP after mediation is failed.

Is there any interim bail procedure in UP?
BRIJENDRA K SINGH (Expert) 13 March 2013
Yes, there is interim bail procedure in U.P.
You can move or file Interim Bail application before Session Court if reject, then file it before High Court. By this procedure you have two chance to get Interim Bail.

You can file quashing petition also in the high court against the FIR wherein the re would be grant of stay on arrest.

First tell me about your FIR, place and status of case. Or call me between 10:00-12:00Am

False 498a FIR is done in UP in Moradabad in Dec, 2012.
Currently matter is gone to mediation centre from IO of Mahila Police Thans and mediation is on verge of failure as wife is demanding huge sum of money.

You can let me know your contact number so that I can call you.

Thank you in advance.

Dear experts,

I came to know that they have already filed 3 caveats in Allahabad.

1. If I get stay order or same day bail order from Allahabad, do we all 5 family members need to go to Moradabad and surrender and apply for bail before sessions court alongwith stay order?

2. Will this be a regular bail or some interim bail?

3. One lawyer said that some days after mediation is failed, I/O officer will send summons to come and apply for 'kachi' bail. After case goes to court after filing sharge sheet, regular bail will be done . How good is that?
Devajyoti Barman (Expert) 19 March 2013
1. After stay of arrest you need not apply for bail.
2. regular bail
3.not good at all.
