Sale of properties by trust

(Querist) 08 March 2013 This query is : Resolved
Dear Sir,

One of my client is running a educational trust.

They are planning to sell of educational instituions under the trust to another trust.

My question is

a) Whether a Trust can sell its assets to another Trust?

b) What will be the implications for selling trust?

c) Is there any specific prohibition in sale of properties of trust?
Raj Kumar Makkad (Expert) 08 March 2013
1. Yes if the bye-laws of the Trust do permit to sale its properties.

2. If not permitted under bye-laws and even then sale is made, the trust can be dissolved by Commissioner of Trusts.

3. No.

STRANGE ARE THE QUESTIONS AND SO ARE THE ANSWERS.

LET ME HAVE A LOOK IN THE TRUST DEED FIRST AS WELL AS THE JURISDICTION IN WHICH THE TRUST SITUATE.

NO ANSWER BEFORE THAT?

Some experts show their jealous unnecessary towards other experts for the reasons best known to them. One may provide his reply as per his own experience and expertise but no one has got authority and power to tease others just for his seniority. Respect is commanded and not demanded.
