Job not confirmed from last 1 and 1/2 year

(Querist) 09 January 2013 This query is : Resolved
I have been working with a company for last one and half year.In joining letter it has been mentioned that
1.I will be on probation for 1 yr.During probation either party can leave/terminate by giving one notice period
2.Upon confirmation , either party will have liability to terminate this offer by giving three month notice or three month pay in lieu of that.
But I have not got any confirmation letter till the date.
Now I want to leave this organization by giving one day notice. What should I do.every sentence is confusing in this offer letter.
what is meaning of one notice period?

request company to confirm whether they have come to any decision as the probation period of 1 year has been completed 6 months back

wait for response for fortnight .

then decide your course of action

in the alternative you can also send a letter that since you have not received any confirmation from company after completion of probation period you are sending in your resignation . that you shall be attending office for period of one month as stipulated in appointment letter

Have you at any time reminded the company about your confirmation after expiry of the probation period?

However, if the absence of any written communication from the company about extension of probation period, you can be deemed to have been confirned and would need to adhere to the condition of notice period after probation period, i.e., considering yourself as confirmed on the post.

Confirmation in the job is the discretionary power of the management, however, such power should be used judiciously and in accordance with the relevant rules so if you find any violations thereto, serve a legal notice followed with labour court case.
