(Querist) 01 June 2012 This query is : Resolved
sir,
i would like to know that undermentioned marriage would be legally valid or not:
Father of my grandfather was two brothers i belong to family of one of them.and the girl whom i love is relative of the family of another brother of father of my grandfather(ie.my grandfathers uncles fmaily).the girl is daughter of daughter of that family (ie. indirectly she would be my neice).we love each other fondly but non of our families are ready for that because there is huge row between us.both of families hate each other its been long row.so i want to know is this incest or not ? i dont want to marry in incest but many of friends say that this is not the incest. If its so what should i do?

since both families are against the match and she is related to you why you want to add fuel to fire?
she is not the only girl in india of maariageable age . find some other girl and marry her

Father of your grandfather,i.e four generations ahead. You said you belong to one family, how is she related to your father's grandfather's brother or whose daughter is she?Nothing wrong in marrying neice.Let us keep this aspect aside. If this marriage brings both the families together its ok,otherwise don't add fuel to fire.

This is a sapinda relationship. Don't get into it.

It i urprise how at all the doubt surfaced in your mind when you are from spinda. The Gotra of you and her Nana is the same. Gotra of baba nani dada Dadi is forbidden.

Section 5 (iv) of the Hindu Marriage Act, 1955 prohibits marriage between persons who are in prohibited degrees of relationship, unless the custom or usage goerning each of them permits such marriage. Clause (v) of the above section prohibits marriage of parties who are sapindas (i.e., of the same gotra) of each other. Section 2(g)(iv) of the Act provides that brother and sister, uncle and niece, aunt and nephew or children of brother and sister or two brothers or of two sisters are prohibited degrees. As you have stated that the girl is your niece, it is not legally permissible unless you have custom in your area that such marriages are permitted. For instance, in the South, custom permits marriage with sister's daughter. I do not think this is so in the North India.
