Break of civil rights

Sir, my elder father is a senior congressman aged about 70+ years. He is affected by asthma and not in a condition to move outside home in the winter. In a mass movement he has been prosecuted under protection of sc/st law. Later on he was granted bail on the same case. the arrest warrant was pending at the police station. Owing to the pending warrant the police arrested him, irrespective of his verbal representations and several requests by us regarding his bail order. the reference was produced, but the police arrested him from his home and taken away to the court of sdjm in bare body without an escort though he was ill and allergic to cold.
After producing before the judge, he was just released saying there was no necessity of arresting him as he is on bail. the act of police was against the civil rights of a senior citizen like him. It is his innocence and weakness that he can proceed against the police. I am not sure about the law against violation of civic rights by the police.
It is an incident of January 2012. Kindly suggest for any relief or cause of action in this regard. many innocent people are being harassed by the police in such cases.
Whether it comes under the violation of human rights or violation of civil rights of a senior citizen with ill health condition. Kindly suggest the best!

If the allegations are true then you may file complaint with the Human Rights Commission.
However seeing the might of the Govt not much remedy is there.

Police authorities can not be permitted for the illegal confinement as has been done in case of your father. Your father can not only file a criminal complaint under section 200 Cr. P.C. but also can move his complaints to Human Rights Commission and higher police officials.

Your case is very much valid to be represented in the Human Rights Commission and it also tantamounts to grabbing civil rights.Immediately lodge a complaint with the HRC,along with the available evidences.It is nothing but illegal confinement.Refer the judgement of Supreme Court

yes!it is violation of civil rights and wrongful confinement of individual liberty and remedies suggested are available.
