Harrashment from neighbour

FROM LAST 6 YEARS , WE HAVE BEEN MENTALLY TORTURED BY VIOLENT WOMAN AND HER DAUGHTER , WHO IS STAYING BELOW OUR HOUSE , LOT OF POLICE COMPLAINT HAS BEEN DONE , YET NO SATISFACTION RESULT RECIEVED

File for a suit of eviction, if the property belongs to you.

Otherwise file a case if nuisance by teaming up with few other people who are as harassed as you are.

It is not clear in which capacity the due occupy the accommodation beneath you and what are their activities that you call 'torturous'and what firs were made in past.

These are necessary facts to be known before any opinion about remedy can be thought of or formed.

If you've got others who are similarly agonized - file a representative civil suit for abatement of nuisance u/s 91 CPC.

If you are able to prove special damage in your favour - you can sustain an individual action for damages for nuisance as well. (Tortious)

Criminal liability for public nuisance may also arise u/s 268 IPC.

There is no definition of mental torture which you mentioned in your query. Unless you come with true facts, no concrete suggestion can be given by any expert as you might have seen the above-noted advice of various experts which tough separate aspects and this is because you are not clear.

Again submit clear facts like ownership of the house and what exact action is taken by those persons which is being defined by you as mental torture.

If your's is a rented premises, my opinion is YOU KINDLY VACATE

If Her's is a rented premises, COMPLAIN her LANDLORD

If both are owned properties of respective parties, if you are governed by any Association, COMPLAIN THEM

If no other possibilities, you need to collect evidence with regard to the nuisance and can file a suit for DAMAGES and COMPENSATION in a Civil Court ( Provided you need to incur expenses towards Court Fees)
