Petition u/s 391 crpc can be filed agasint an exparte order

Dear Fourm,

Facts:
- Court passed interim orders on maintenance filed U/s 18 Hindu Adoption & Maintenance Act.


- The order passed by Dist Family Court was an ex parte order on her favour.


- ex parte order on maintenance was not challenged/set aside.


Husband has to take care of the only family (Old Parents) and travelling from once city to other could not proceed further due to financial problems.

Opposite party did not file EP. till date.
As such, she got married after an ex parte divorce was granted on her favour.


Lost job due to 498a enquiry in the office.
498a proceedings are going on.

In this connection Husband can file Petition u/s 391 CrPC to the Appellate Court after lapse(15 months) of limitation period.
