Querist : Anonymous (Querist) 25 January 2012 This query is : Resolved
Can anybody guide me for the solicitor's exam ? I have following doubts?
1) In the interview for articled clerkship what type of questions can be asked?
2) How to prepare for the exam?
Shailesh Kr. Shah (Expert) 25 January 2012
can you explain more about solicitor's exam??
ajay sethi (Expert) 25 January 2012
hardly any questions . your marks in LLB are taken into consideration . no legal questios are generally asked .

you have to join the solicitor firm do articles then appear for exams conducted by association . most of subjects are what you have studiedfor your LLB

There is no such thing called Solicitor's examinations at least at this part of India.

R.Ramachandran (Expert) 25 January 2012
Dear Mr. Assumi,

The Bombay Incorporated Law Society conducts Solicitors Exam regularly.

For sitting in the solicitors exam, a LL.B. Graduate has to first become an articled clerk for three years under a law firm solicitor who has been qualified for five years.

Each solicitor is allowed to supervise up to three articled clerks.

Articled clerks work at a lower salary than associates at firms and are usually given six months off in the run-up to the exams to prepare, with questions potentially testing the legal knowledge of every statute in existence India.

There is a prevalent view, that due to their rigorous training and guidance under a Solicitor, people who are passing the exam have great practical knowledge of the law and can quickly find the right section of legislation when asked by clients.

The exam is intentionally made very difficult to pass. The percentage of pass in the said examination is very very less.

The exam consists of six papers, each of which is sat by candidates in two-day intervals.

The topics are practice and procedure, corporate law, conveyancing, taxation and accounting, general commercial law, and "general lex", which tests knowledge of miscellaneous other areas of law not covered under the other heads.

The corporate law paper had practical problem and factual questions on such areas as the Companies Act, the Securities and Exchange Board of India (SEBI) and the Foreign Exchange Management Act (FEMA).

The pass score in the exam is 360 points out of 600.

The Bombay Incorporated Law Society was founded in 1894 as a supervisory body to solicitors or attorneys, who at that point did not enjoy rights of audience in courts, which was the preserve of counsel.

The division was abolished in 1976 and the solicitor qualification became a title that offered no legal benefits over advocates but still offered career opportunities and increased pay.

However, solicitors continued to dominate Mumbai's legal market outside of the courts and at many more traditional Mumbai firms the majority of partners are solicitors.

Dear Mr. Tom,
I really do not understand why do you say that even an upcoming solicitor hesitating to ask any query and that too frankly?

Please clarify what made you say so.
Did I, at least, unknowing to me or inadvertently, did or say anything in my reply because of which any one would be hesitating to ask a query?

I am concerned. In hindsight I start feeling that I should not have answered the query at all, if it will unnecessarily make anybody hesitate to ask any query here.

RR,

TOM WAS BUSY CHANGING HIS RED SHIRT, AS I FORCE UPON HIM ON THIS AUSPICIOUS MORNING OF REPUBLIC DAY. before 40 minutes.

Your reply was very correct, and in detail,

Now Let us comment on this new shirt,Tom Looks better or not??

NKA: Assam probably do not need to hear it.
Advocate. Arunagiri (Expert) 26 January 2012
Mr.Tom is always objecting the advocates, raising the query as anonymous.

I think he feels that this query is also from an advocate.

I think Mr.Ramachandran also not interested in attending the anonymous query.

My personal opinion is, when some body is hiding a mask, it shows that they dont want to reveal their real face here.

I personally dont worry about the person who is asking the query. I am objecting the academic queries.

R.Ramachandran (Expert) 27 January 2012
Dear Mr. Tom,
I might have given the answer to the query.

But, really I did not understand what you mean when you said "even an upcoming solicitor hesitating to ask any query frankly.."

In my hurry, I read it as "even an upcoming solicitor WOULD BE hesitating to ask any query frankly.." (which is my folly and certainly not yours.)

With the very nice clarification of Mr. Arunagiri saying "Mr.Tom is always objecting the advocates, raising the query as anonymous.", I could understand the context and meaning of your comment.

(Dear Mr. Tom, even this post of Mr. Arunagiri I saw only after sending the reply to your PM.)

Now, no confusion at my end. Thanks for Mr. Arunagiri for putting things in proper perspective.
