Divorce case

(Querist) 18 January 2012 This query is : Resolved
Hi, Please advise for below divorce related cases, my 3 cases are running
No. 1 divorce case (based on her mental nature and cruelty) filed by me in Oct 2009 in Chandigarh but now transfer to Shimla.
No. 2 Case for maintenance charges filed by wife on DEC 2009(presently Paying Interim charges Rs. 2000/- Monthly)
No. 3 Restitution of conjugal rights filed by wife on DEC 2009.

At present all cases are in Shimla district court with 3 different Judges.

My main concern is expenses, actually i am paying 3 times fee to my advocate, and also getting 3 different dates for hearing, so my expenses are increasing.
Is it possible to place a request to close the Maintenance or Conjugal right case and all hearing should be made with one court.

if you have engaged a single lawyer for 3 cases request him to quote the fees on lumpsum basis if possible for the 3 cases or on yearly basis .

family court can club ur divorce , maintenace and RCR case
Shonee Kapoor (Expert) 18 January 2012
Rightly advised by Ld. Mr. Sethi. But if there is no family court, then also Divorce and RCR should be clubbed.

Hello
Shonee sir, please advise, is there need to file any petition / request and under which section this clubbing can be done.
After this knowledge i can do bargaining with my advocate for discount in FEE, because after than their will be only 2 case counted.
Deepak Nair (Expert) 18 January 2012
You have to file an application to the principal judge of the court requesting to club the three cases together as the same is connected and the outcome of all the cases will effect on the other cases.
Raj Kumar Makkad (Expert) 18 January 2012
There is no procedure for clubbing RCR and divorce petition but those can be got sifted in a single court. Fee is always negotiable so follow the advice.
