Car parking

Querist : Anonymous (Querist) 14 January 2012 This query is : Resolved
Hi,
I am a member of Co-Operative Society, Dombivli, Thane and I owned a car. I am parking my car in the open spaces of the society in front of my own flat which is at ground floor. I have not purchased this parking space as there is no such concept of parking space in our society. I am regularly paying parking charge of Rs. 50 as per society rules & regulation.

But in one of the meeting, society decided that in the day time the car should be park outside the society premises. There are around 6 two wheelers but for them this rules is not applicable.
My questions
1) After paying charges as per society rules can society ask member to park a car outside society in a day time? Is this legally right? There is enough space for parking.
2) Can there be a separate rules for two wheelers and four wheelers regarding parking (i.e. with regards to parking time)?

Please advice

1. This is illegal.

2. Yes.

Rightly stated by Ld. Mr. Makkad, however for part 1 of the query, if it is done on some specific dates/ events/ occasions, it would not be termed illegal.

Hi Expert,

What i understood from the ans. is Society can not ask me to park a car outside the society premises even in the day time. Yes for specific event i agreed society can ask me and I am OK with that.

But they can not ask me everyday to park the car outside in a day time. Whis is ilegal

AND

If they are asking four wheelers then this rule should be there for two wheelers also. RIGHT?

thanks
