Legal heir declaration

my client's husband died in Behrain. the embassy of India, Behrain ordered to produce legal heir certificate from the court to get claim from the Behrain social insureance law. which court has jurisdiction to file suit for declaration of legal heir and under which section. kindly inform to me procedure to file suit for declaration of legal heir.

Heirship Certificate can be issued by a 1st. class Gazzetted Officer.If however, the Embassy is insistent on a court order(if that be the requirement in Bahrein), U will have to apply to the District Judge where she is presently residing.

You have to file a petition to that effect before the district judge in whose jurisdition your locality comes.

To claim insurance amount, it would be better to apply as per law of Behrain social insurance law.

The heirs of deceased have to apply to DM showing their relation with deceased and the law under which they are claiming the heir ship,the application would be referred to SDM who in turn call for a report from tehsildar who in his turn call a report from Lekhpal and accordingly application shall reverse back and desired certificate would be issued.

As it is social welfare insurance of a foreign country against which you do not hold any policy or details,no succession certificate under Indian succession Act would be possible to be issued.
