Ipc 66a

Querist : Anonymous (Querist) 06 January 2012 This query is : Resolved 
Cyber Crime Police has filed a case against First Party under ipc 66A on complain of Second Party. And FIR has been filed in Jan 2011. Cyber Crime Police team raided at First Party's office in June 2011 and sealed his laptop. Case is still under investigation, not moved to court. Now both parties want to compromise but Investigation Officer is denying for it. He is saying that now filed case under 66A is between First party and Government, so compromise between both parties is not possible. Please guide and suggest me.

There is no IPC 66A

As this Cyber crime u/s 66A
(it act ,2000)
is punishable offence with imprisonment for a term which may extend to three years ans also with fine , for sending offensive messages ,
& as CYBER CRIMES ARE ON INCREASE ALL OVER THE WORLD
Government Policy to control it ay high handedly.
It is also a need of the hour, and we shold encourage punshment to set example
We should not let them go, with payment of money.

Yes the Police may not seal the deal as it is making compromise.

You first obtain the bail and then move the High Court on consensual Quashing of the case.

Police can also enter compromise as the challan has not been filed before court and investigating officer can file discharge application before court.

It shall be better for the complainant to approach SSP of the area and bring all facts before him and pray to quash FIR as course of trial shall take a long time.
