sir, management committee of a college was dissolved and controller was appointed in 1977 . since 1977 controller is holding office till today . renewal of the society under section 3 (a)of the society registration act was not completed because management committee was suspended . now controller of the society was appointed election officer to hold election . whether election of the management committee will be valid in the absence of renewal of registration.

No. such election is invalid until renewal is made.

I find no reason to differ with Mr.Makkad.Very simple is the point that in absence of renewal there would be no society in existence then for whom and for what any election can go?????

There is no Section 3(a) in the Societies Registration Act, 1860. if a Society is registered under the Act the registration holds good until the Society is dissolved under the Act. From the statements made by the Querist, it appears that the college has been functioning as an unregistered body and that the Controller has been appointed by the Court on supersession of the Committee.The querist may check the correct facts. If the Controller has been appointed by the Court, he will function under the Control and directions of the Court. It is surprising how the Controller continued for such a long time without holding elections. If he has now decided to hold the elections the same cannot be questioned.
