Nullity of marriage

Querist : Anonymous (Querist) 28 October 2011 This query is : Resolved
Is declaration of Marriage as Null and Void on the ground of recurring mental disorderliness (Schizophrenia) of a spouse possible?

Does suppression of fact as regards mental condition of a spouse enable the other spouse to have their marriage declared as Null and Void if the mental disorderliness referred to in previous question gets cured?
M.Sheik Mohammed Ali (Expert) 28 October 2011
if you can proved before marriage he/she affected above said disease, then only court declare.
Sankaranarayanan (Expert) 28 October 2011
yes i do agree with mr sheik you have to prove the reason before the court.and all subject to the court acceptance.

It is not a case for nullity.
You better try your luck in a divorce case.
prabhakar singh (Expert) 28 October 2011
rightly said by Mr. Devajyoti Barman, yours is not a case of nullity;however even trying divorce may not yield as you have stated it to have been got cured.
Shailesh Kr. Shah (Expert) 28 October 2011
Do as advised by Shri Devajyoti Barman.
ajay sethi (Expert) 28 October 2011
if mental condition has been cured no case for divorce made out

It also would depend on what is the degree of mental illness.

And it can be declared null and void only, if you stopped cohabiting with your spouse after discovery of this fact.
