in criminal case 498a, is possible to get cctv footage from bank locker, where wife enter and took jewelary from locker date is know.

if yes, under what crpc

yes you can call the cctv footage from the bank at the of defence evidence under the provision of Cr.P.C.

You can produce any evidence, whichever is in your favour.

Such footage is duly admissible in evidence. You should also put this question from the complainant while she appears in her evidence and then should bring this in your defence evidence. In this way, such evidence shall be given more reliance.

under which CRPC i can request such footage

bank guys say they can provide footage only when directed by court or police.

I had requested police, but they are not intrested in helping husband side.

Ask your lawyer to made application before the court, The court will direct the same.

But,Million dollar question is that how can you prove that she took jewelary from locker??

the footage will only show she has entered the locker room . how do you prove that she has removed all the jwellery in locker when there in no CCTV in locker room

CrPC 91. But that doesnot prove conclusively.

However, if the lady is the person who last operated the locker, the presumption is that she has the jewellary.

yes, it was last operated by her,

assuming I dont get desired result from crpc 91 or footage not available due to time limitation and backup policy of bank.incident happened in july 2010

What is option i have against the her allegation, how can i prove it was taken by her.

There is another book evidence. The Bankers maintain a register with particulars of date, time, locker number, name of the visitor under his/her signature in the register duly authenticated by Bank official. This proves who has operated the locker on what date and at what time.

You can act upon the advice of Mr. Jaggarao, as an alternative. Rather the record of the said is a perfect proof, as that contains name and signature of the operator besides time of entry and exit on some specific date.
