Evidence before charge

in a complaint case my advocate said that Evidence Before Charge will be conduct before the Ld. Court and then Trial will commence, kindly guide me about Evidence Before Charge in a Complaint Case. and also I want to know whether Defense Counsel can Cross Examine me or not.

yes, you will cross at the time of examination.

This procedure is adopted in warrant cases not instituted upon police report. Go thru the chapter 19 of Cr.P.C.

You have to examined by your Lawyer and also crossed by the defence lawyer,before framing of charge by the Court.

there r 2 two stages in recording of evidence in complaint case one before and one after taking cognizance...u can give reserve ur evidence and produce it at the time of next stage..dats our observations
