Repayment of money lended to a relative.

Dear Experts,

I am seeking herewith your expert advise on a matter which has landed me in great mental disturbance.
I have had happen to 6 years back lent money amounting Rs2Lakhs to relative who had happened to get married and was requiring monies to finance his marital life.
Under good consultation with other relatives especially his sisters and other relatives happened to provide him the necessary money.
It is now 6 years that I have repeatedly asked him to pay back and also knocked at the consulted relatives but have received only abusive negative replies.
I am fully now aware that this relative has no intention to pay me back my money and hence I want him to learn a lesson that borrowing others hard earned money is not a joke.
So could you people guide how can I bring him to justice and is there any Indian Law to support me.

In the fact situation narrated by you, since the loan was more than 3 years old, you have no chance of recovering the amount in a legal manner.

On face it is time barred bad debts not enforceable by process of courts but by creating evidence of loan advanced with in two years on basis of evidence bought from relatives if possible lesson can be taught.

Yes. Legally your case died.. Even by creating evidences you can try for your remedy.. I hope you don't have any promissory note. Its ok. Just try to find any circumstantial evidence for corroborate your transaction.

However,you have to manage some transaction in the last 3 Years as part payment made by the debtor,and or payment of interest he made to you in last years,which may gives you some relief.

As it appears your case is barred by limitation. However,U should try your luck taking advantage u/s.88 of the Trust Act.
Expert guidance is a must.
