breif facts-summon not recieved for 1st time in 125 Manintennace case

1)how many times can summon be sent back.
2)can judge make ex-parte order on 125 case when summon not received
3)what is the procedure that needs to be followed .

how many times you refuses it, but remember if you refused to accept the summons police can endorse it that refused and return it to the court then you will be placed as an ex-parte

it will depend on the fact, when court is satisfied about the service of the summon. It may satisfy on the first time and may not be satisfied after number of repeated service.

In 125 cases it is seen that the summons most reasonably tried to serve and if served there may order to that effect as exparte as your presence for denial is required and if you do not get represented shows that itis deliberate. It is not time bound or no. bound but prima facie for a reasonable man if it appears that he has tried his level best to serve the party and the party has denied or evaded summons intentionally then court may order for palcing the party exparte
