Cancellation of bail case

Querist : Anonymous (Querist) 30 March 2011 This query is : Resolved
Can a regular bail be cancelled in case of IPC 354 if the accuse is not doing anything wrong and is not trying to influence any witnesses. What can be the grounds of cancellation. Is there any time limit within which the application of cancellation can be filed by the victim after the grant of the bail.

This is a flase case of 354. But the accuse is a family person and is in a very bad state financially and emotionally due to this case.

Application for cancellation of bail may be moved any time up to the judgment. But if accused is not doing anything wrong and is not trying to influence any witnesses, and following the conditions of bail as imposed by court, bail can't be can canceled.

Yes there is no tme limit for cancellation of bail and the supreme court in some well recognised decision has provided guidelines that the bail should be cancelled very sparingly and only in a clear case of violation. It has also made a distinction between rejection of a bail and the cancellation of a regular bail.
