Querist : Anonymous (Querist) 16 March 2011 This query is : Resolved 
Respected Experts,
I and my wife living separatelly since 2006 but I lost the divorec case moved under SECTION 13 (1)(ia)and (ib)of Hindu Marriage Act, 1955 in District court.

Now can I move new Petition for Judicial Seperation under Section 10 (i)of Hindu Marriage Act, 1955.

Any others advice is welcome as this stage restitution of marriage is not possible from my side is not possible nor from her side. But she is intentionally tortureing me.

if both of willing to separately to stay both of them apply mutual consent divorce apply the court it will easily get the divorce with in 6 month

No, it is barred by the principle of Constructive Res Judicata.

In any case you need to search for the old case and need to withdraw that to file a new case even if it is a mutual consent case
