Sir,
Settlement of personal loan done in Mediation CENRE OF dWARKA cOURTS.
1.settlement letter signed by accused ,Bank
Mediator A To withdraw two cases of sec. 138
B Make payment by 05/09/2010

c. To issue NOC in 15 days of receipt of payment.

A & B COMPLIED BY BANK AND ACCUSED RESPECTIVELY.

C NOC DENIED BY BANK.

ADVISE FURTHER ACTION FOR ISSUE OF NOC.

If the settlement was done in writing then issue notice to the bank first to comply the settlement in to-to failing which file suit for specific performance before civil court. If no written settlement exists then it is very difficult to get executed your oral adjustment/settlement.

If the mediation center was set up to function as Lok Adalat then it has ot the power to execute the settlement. Approach it asap.
