(Querist) 10 October 2008 This query is : Resolved 

I was working with an PSU.my wife had complained in writing vs me to my P&A dept.(complain is like, my marriage to her is second marriage & i had affair & cheated the company etc.)& defame me in all possible ways. i resigned from the post immediately as my mistake was, i had produced wrong records to the company in past with respect to martial status to get some monetary benefit(LTA Claim).after my actual marriage i had informed to my said wife about this.she then suggested me to change the records.but meanwhile we had dispute as a result she has exploited the opportunity &highlighted my mistake to my management in writing to teach me lesson for not obeying her.& asking them to sack me
company has not accepted my resignation.& issued charge sheet to me & subsequently third party inquiry.
i had neither answer the charge sheet nor appeared for the inquiry.later on company has dismissed my service.
i had married only once but my wife knowingly damaged the things.
now my query is if i have to get her complain letter to my management through RTI how should i proceed.which RTI office i should write.
pl suggest

Dear Madhukar,
You can ask the company about complaint letter, evidence, chargesheet, inquiry report and order. As you are the affected person, in any case they are required to provide these documents to you.
Otherwise also, you can ask for these documents from the Public Information Officer of the company.

Usually in a PSU, after completion of inquiry a show cause notice is issued to the deliquent employee and copy of the inquiry report is provided to him. Even after the disciplinary action is taken the employee has a right to representation before an appellate authority. You should have been provided with a copy of the report and that perhaps would have a mention of the said complaint by your wife. If it is not followed then my opinion is that follow Mr. Rajesh advice as aforesaid. If the same is not provided to you, you have fair chances of proving the inquiry as bad and vitiated and fight against your termination. Otherwise you can approach them under RTI Act and apply to PIO which is designated in every organisation for required information.
