my wife who is with her parrents, bore my son last month and so far she did not let me about this good news......and at this stage I just want to meet my son.....and want to keep my son in my custody....kindly suggest me....

Under no condition court can grant custody of a 1 month old child to his/her father.

No it is not only against the law but also against the nature. Have patience and apply later. You may apply for visiting rights.

A one month old baby needs the care and attention of its mother rather than anyone else. So, the court'll never grant custody to you at this stage. As suggested by arvind you can apply for visitation rights now.

you have not stated reasons for demanding custody of one month old child which justify your demand mere your wish is not legal ground. court always consider paramount welfare of minor child

Experts mr.arvind, archana, and prakash given a exact answer to you. What you are talking mr.. If you file any petition for custody of the child mean its surely wil be dismissed without numbering. If you want you can get visiting rights. More over if your affection on your child is true mean take your wife also with you. Thats only the nature of justice

I slightly differ to views expressed by all the ld. members on sole grounds that a father is not only a seed giver but a protector too and has equal rights to nurture the sapling !

I place my reliance to below recent case reported in a newspaper [the child here is 14 months old but if a father really loves his own child everything in this planet are possible legally come what ld. and respected members may say is my humble view]:

It is not only Law but the Law of Nature itself does not permit you to do so.Be patient and be a happy Father till the differences are iron out.

other is the best caretaker of the child, It is High Court observation. Your baby is just one month, except mother you cannot take care.

How ever if the court ordered to custody the child with that father mean, its wil be a victory to father.. But its wil be justice.. Surely its wil against the nature of justice.. Thats my opinion

u cannt get custody under any circumstances at this stage but only access u can have and that also for limited period
