legal notice

(Querist) 02 August 2010 This query is : Resolved
Dear all
I requested for discontinue for my reliance broadband connection in sept month. I have not saved any complain# for telephonic conversation but i have all email. At that time they told me to continue till last billing and I already paid for that period. But reliance did not cancel my connection is continuing sending bill. Now I got a legal notice(prov of sec 62 of the arbitration and conciliation act, 1996) form there there advocate to attend constellation camp organized by chamber in Bangalore behind kaveri bhavan . if i failed to come forward for conciliation they take appropriate legal procedure and its my own risk, cost and consequence.
Please suggest what are the options I have and what is the procedure for submit form in consumer forum. hope i'll get reply very soon.

Thank you in advance
kamal

Without giving you the notice and without your consent the other side can not appoint arbitrator though he may be mentioned at the time of agreement. Relax he can not pass any legally tenable order.

Conciliation is one of the ADR (Alternate Dispute Resolution) methods. Nothing can be forced on you. If you dont want to, you cannot be forced to go. This is not a Court Summons. This appears to be a Lok Adalat hearing or a Conciliation Camp. There is no harm going. Take all your email correspondence. You can put forward your points, agree to pay ONLY what you feel is fair, and if it is OK with them, you can settle the matter peacefully. Once this issue is settled, it will not open again. No corporate would like to waste time to go to courts for small amounts.

From last three months I am facing the same problem.

Reliance net through internet is virtually free but through dealer you have to shell two thousand plus for data card and they charge inflated bill from day one.

Thereafter even disconnection intimation is given no body listens and the collection people are after you.

So now go to TRI site where you will get the email IDs of the top persons, make complaint to them. Then there is one more autority to whom you have to contact if things are not resolved.

Thereafte make complain to TRI.

I am going though that process.

Relaince people do not have regular business since heavy competition from BSNL and others so they play such dirty tricks.

Dear Kamal,
Since you have all e-mail communications between you and the Reliance broadband, you can approach Consumer Forum. This is a clear case of deficiency of service and negligence. If you have lodged a complaint for dis-continuation of service, they can not impose bills on you.
Make a straight/simple complaint annexing all the communications between you and Reliance and the Bills sent by Reliance Broadband along with Conciliation Notices. Make sure that you are providing complete address of the Opposite party in the Complaint so that Notice issued by Forum can reach the Opposite party. For complaint filed in Consumer Forum or making appearances before Consumer Forum, you do not even ned to hire a Lawyer.

Please also note that Reliance cannot impose the conciliation order upon you in any way since you have sufficient proof for filing complaint regarding dis-continuation of service.

Dear Kamal,

Please specify the date when you have filed the complaint with Reliance for dis-continuation of service and all other relevent dates as well in the consumer complaint
