Legal heir

My husband was worked in tamil nadu state government employee. He was a teacher in education department. When he was expired at the age of 46. He had completed 15 years service in government. He had a pension scheme. Myself and my daughter are nominees he mentioned in his service book. So who is eligible to get his graudivit and pension?. As per service book nominee or legal heir authority.?. Because my mother-in-law name include in heir certificate.

You and your daughter are nominees as well as legal heirs. Your Mother in law also is a legal heir. After giving her share in your late husband's pension, you and your daughter can share the remaining pension; Or if relationship with your MIL is good all 3 of you can share your late husband's pension you AND YOUR DAUGHTER GET LEGAL; HEIR CERTIFICATE FROM LOCAL TEHSIL OFFICE.

Deceased person's mother ,wife and daughter are all his legal heir and entitled to equal share in pension, PF, and gratuity and other retiral benefits and property left by him. Nomination in service book does not make you and your daughter exclusive legal heirs,

In terms of CCS(Pension) Rules applicable to Central Government servants, mother are and daughter are entitled for the gratuity. Please verify whether the same norm applies in respect of TN Government employees.

As regards to Pension, wife is entitled for pension till she is remarried. Subsequently, the daughter is entitled, subject conditions as to marriage, ege and employment.
