Cheque clearing issue.

Dear Sir,

My Name is Anupam Saxena & i am working as a Assistant Accounts Manager in a Pharmaceuticals Company, My Query is that i had a Cheque of HDFC Bank & Deposited in Axis Bank. Because the Account in Axis Bank. Problem is that the name on the Cheuqe was Yatish Kumar & the Axis Bank A/c No. Name was only YATESH & the bank official take the Cheque for Clearing. Now Problem is that the in the Statement HDFC Cheque is Debited & Showing under Clearing. So My Question is that is this Should be Clear due to name differ or if Cheque is showing under Clearing in my HDFC Bank Statement. will it be Reversed.

Please Suggest me the on this Matter.

Performance appraisal reports

My performance appraisal report were replaced with a new set of documents 15 years back to deny me promotion. I have obtained fresh evidence that my reports were replaced. The evidence contains ratings given to me by reporting, reviewing and countersigning officer, prior to replacing them. The above officers involved in rewriting and replacing my reports have retired from services. Can I file an FIR with fresh evidence against the above officers.

Gratuity clarification

To Pradeep sir, Sir need clarification on gratuity I.e. as central govt employee does not gets gratuity even after 15 year of service whereas in private or public sector qualifying service is five year and employees are eligible for gratuity….

Whether is it not a clear case of error in two different law central govt vs state or PSU gratuity rule?
becoz gratuity is a honour which has to be given by employer ? Apart this in same case if a central govt employee gives technical resignation and absorb in PSU or in state govt and than if he becomes eligible for gratuity if qualifying service is more than five year and if he can give resignation after absorption than all is ok….

totally contradictory?? Kindly clarify sir… whether ground is available to file a suit in above case for gratuity??? A central govt employee had given resignation after seven year of central govt service but he is not eligible for gratuity.

Rectification deed

I purchased it from the original allottee.In the sale deed of my house all four sides are mentioned wrongly due to the oversight by the development authority. The mistake crept in resale registree also. I want to sell it now but buyers insisted on Correction deed for the wrong sides. I have got the site plan revised and thus mistake corrected in the records of the authority but the original allottee refuses to cooperate for signing the Correction Deed. What alternate way is left for me. Please help!

How a beneficiary/executrix of a registered will get the will executed? Beneficiary (sole beneficiary) of a small house property which is self-acquired by her father, belongs to a Christian community residing in Karnataka, Dakshina Kannada. Has 6 siblings, and all surviving, mother who had life interest deceased in recent days, and a sister had interest until the mothers demise. Shall be grateful to have your expert guidance

Defence in money recovery case

I'm defendant in money recovery case. But complainant has to pay me money in some other matter. Hence I have not paid him. Can I take that defense stating that he is due to me which is more than the suit filed amount. I can submit documents pertaining to defense.

Error in the execution date on the sale deed

Hello
My sale deed was executed in Bangalore in the month of Aug 2022, but on the top of my sale deed the date that was printed was of July 2022, but the registrar had put the correct date on all the pages when they were signing. Only the first line with the date is incorrect ie the line is "this Deed of absolute sale is made and executed on this date in Bangalore" Here the date is incorrect one.
Will there be any complication due to this error?
if yes, what should i do now ?

Resignation and appointment at special general body meeting

Dear learned experts,
Can a President /Treasurer/Secretary resign in a special general body meeting or it must happen only in the annual general body meeting? what if any of the board members are not willing to continue until the annual general body meeting? can we accept such resignations or new admission in the special general body meeting? Appreciate your guidance

Gift deed question

Hi
My ex-husband is in the process of gift-deeding his property in Srirangam to our minor children. He says he has done the deed, however, we were not asked to sign. My questions are:
1. Is the donee not required to sign in the deed? only donors' signatures will do?
2. Is it the same as a sale deed?
