How to do rectification as owner died issueless? The plot is in my possession for last 22 years and BBMP tax is up to date. I got A Khata from BBMP. City is Bangalore
If your sale deed has incorrect boundaries due to an error, and the original owner has passed away without heirs, you may need to file a declaratory suit. While paying property tax to BBMP doesn't grant ownership, your continuous possession for over 22 years with an A Khata is strong evidence. In such cases, a rectification deed might not even be necessary.

When there are no legal heirs to your owner, you can file a declaratory suit in the court.

What type of error existed for filing / execution of a "Rectification Deed" as proposed ? Payment of property tax paid to municipality (BBMP) do not confer title (ownership) rights. When you have uninterrupted and continuous possession of the property for the last more than 22 years, as stated by you, there is no need for seeking any rectification even if there is some error in principal deed .

You can get the land surveyed and boundaries fixed through the competent authority.

Under Indian property law and the Registration Act, 1908, a Rectification Deed requires mutual consent and signatures from all original parties (or their legal heirs). Because the seller died issueless (without direct children/heirs), a standard execution via a Sub-Registrar is not possible through a normal legal heir route. Since you have maintained continuous possession for over 12 year, you can file a suit for declaration to declare the title in your favor based on the law of adverse possession. Upon receiving the court decree declaring you the absolute owner with correct plot boundaries/survey details, register the decree at the local Sub-Registrar Office. This permanently cures the title without needing a seller's signature. If the seller died without children or a spouse, check if there are any surviving Class-II legal heirs under the Hindu Succession Act (or relevant personal laws). Apply for Form 15 EC on Kaveri 2.0 (Karnataka Registration Portal) for the last 30 years to verify all entries on the property. Have your existing Sale Deed, A-Khata, and BBMP receipts reviewed by a civil advocate specializing in Karnataka land records.
