Dear Sir,
My father who was flat owner passed away without registering a flat nomination and no will made by him .
We i,e. myself and sister want to transfer flat in our mothers name
What is the exact procedure. We Live in mumbai in CHS .
Respected lawyers of the forum,
My father owns a vacant site which he bought in 2000 in Bangalore North, it was 30*60. However subsequently our neighbour has purchased site next to ours from the same land owners the site size was 50*60 however it was registered to them as 55*60 in 2010. In 2015 they have built their house which clearly encroaches into our site and have taken our 5 feet reducing our site size to 25*60, however they show documents that shows that they were registered that extra 5 feet by the land owners. They have a compund wall covering upto 3 feet and then their structure is built.
Now we have tried to settle amicably but the neighbour is not cooperating. We have all the title deeds, khata, property tax paid receipts etc to prove our ownership of the site for 30*60 from year 2000.
I really want your help in next possible steps.
Can we remove their compound and claim the 3 feet inside it, if not what other ways are there for us to recover or get compensated for this.
Thank you,
Jeevan

my husband got notice 15 days back from his elder sister through her advocate that our father signed no will therefore the property should be divided into 1/4 share to each one and she come to know from a reliable source in Feb. 2021 that my husband going to sell this house on forged documents so it is a criminal act, he have no intention to sell. My husband living in his father house with me and son and daughter-in-law, she and other sister knows that father had signed will in 1995, she said my husband and other family members forcibly entered the premises after the death of mother expired in 2013 father expired in 2011 but we all are living with father when he was ill we took him to AIIMS but he had head injury as per doctors told me to keep him at home at that time, his age was 83 at that time, very weak
subscribed medicines. All the neighbors knows and can confirm in the court. Now sister demanding 12 lakhs I offered her 4.5 lakhs as she is my sister and the family should not go to court. What should I do? Can I go for probate now or it is not possible after advocate notice? I illegally occupied 300 sq. ft. of
vacant space in front and back side. everyone illegally occupied, actually two rooms allotted covered area
288 sq. yd.

My father had registered a will of all the property he had in my name and my brother's name in 2009 .
In 2018 he sold a part of his property without removing the portion mentioned in the will and without consulting us .
He gave the buyer the status of power of attorney
My father died in July 2020
Now that property got registered in the name of the buyer
Can I challenge it after the probate case for the will is over ?
Please help
The amount paid to my father was very less compared to actual property value
Can I file a civil suit stating that the transaction was fraudulent and cheating .

Hi Experts, I have purchased land in Lucknow which is u/s143 and converted into non agricultural. After registration, when I see my property on bhulekh, it is still shown under old owner even though registry is under my name. Can I resale this property without dakhil khariz? Some one told me dakhil khariz not mandatory if land is u/s 143. Please advice.
I have a plot in a township in Delhi NCR. The developer had promised to us club membership charges in 2010 of Rs. 50,000 and did not started any construction till date. Now they are suddenly asking for Rs. 75000 plus GST for the same and are saying that taking club membership is mandatory for all residents/owners.
Please advise on following:
1) Is it legal for builder to ask for club membership charges 11 years are contract and 5 years after actual possession of plot.
2) Is it legal for them to increase the charges without any information- they have not sent us any letters just mails, which we did not received.
Urgent response will be appreciated.

Though I have received reply from one of the lawyers, I am not satisfied with reply. IN 2012 the high court gave a judgement stating that the maintenance charges should be same for all then premises irrespective of area as the common charges i.e. security, lift maintenance, electricity of the society, manager's salary, office expenses, and other common charges shall be same for all occupants except repairs which are based on areas and municipal tax which is separate for each premise.
Kindly therefore look into the judgement and clarify exactly the meaning of this judgement.
Mhada noc required for purchasing flat in the building
The building has been constructed after taking MHADA NOC. The plot is owned by MHADA which is taken on lease for 90 years and the building has been constructed. The question is will there be a need of MHADA NOC separately for selling/ purchasing any flat in this building even if MHADA NOC is already there with the society?
** Note: There are banks which has stated that only NOC from society is enough while there are banks (example: Axis bank) who demand separate NOC from MHADA too.
