Maintenance issue

Facts –

A notice has been served to me by the family court in connection with a maintenance case instituted by my wife.

I have to submit my written statement in this regard.

I have serious threat to my life in the city where this case has been instituted.

My Queries –

1. I don’t want to appear in the family court at any cost because I have serious threat to my life over there.

2. But I also want to submit my Written Statement (WS) in the court.

3. I also don’t want any interim maintenance relief from the court to my wife due to of my absence on the coming date and

4. I also don’t want the matter to go in ex parte.

Please suggest the suitable procedure to accomplish all these at once.

You engage a lawyer by providing vakalathnama in his favour and he shall defend the case in your absence all desired acts can be done on your behalf by him.

If you do not want to engage the lawyer of that city then engage from your city or tell me. I can arrange for you for any city in India.

Your problem has partly been replied by Ld. Mr. Makkad.

However, if the threat is genuine you can also move to HC/ SC for transfer of case. This would give you time for mediation and to probably settle the case.

You want too many things..
The courts do not work as per your want.
If you do not appear the WS would be of no value and the court would be going to hear the suit ex parte soon.

1.Report to the court in details facts leading to such apprehension.

2.It is legal need if desired to be contested.

3.It is up to court and not your wish or desire.

4.You need to pursue the case properly.

Choices:-

1. Either to go for TP in Supreme Court before submission of the WS in family court.

Or

2. Submit the WS in the family court through a lawyer.

Which will be good?
