What are other deduction can HR department has to impose against SALARIES a part from statutory deductions like PF/ESI/PROF.TAX/TDS etc. My quarry is; late attendance, misbehavior etc.directly deducted from Salary of workmen ?

Please note as per the Factories Act, Sec,79 " EVERY WORKER WHO HAS WORKED FOR A PERIOD OF 240 DAYS OR MORE IN A FACTORY DURING A CALENDER YEAR SHALL BE ALLOWED DURING THE SUBSEQUENT CALENDER YEAR, LEAVE WITH A NUMBER OF DAYS CALCULATED AT THE RATE OF ;
(i) If an adult, one day for every twenty days of work performed by him during the previous calander year.
QUESTION:
While taken the above, the twenty days are excluding WEEKLY OFFs , NATIONAL AND FESTIVAL HOLIDAYS, OTHER LEAVE DAYS.( Approved CLs, SLs etc) OR including the above.
In some industries they are excluding and some are including for the calculation of 20 days of working day 1 EL / PL / Annual Leave.
WHICH VERSION IS TRUE ?

Dear Experts,
One of an employee is transfer from the present place to other place with some extra benifits. But the employee while the dedline of the date is comming then he submitted a letter that "I am taking some medical treatment so I am unable to go to the transfered place". Then management wants to issue a "Termination" letter is it fair or not. As per the appointment letter he as to work any place of the firms situated.

Dear Experts,
Recently our management has changed policy of benifits to the employees in that event the Employer's contribution has increased even if the Employee's contribution is lower than the cealing limit i.e.Rs.6500/-
Ex. If one employee contribution is Rs.5000/-(Basic)on that 12% PF deducting
he will get Rs.600/-PF
AND
Employer will pay @ Rs. 6500/- from his contribution @ 12% he will depositing employees accounts Rs.780/-.
So in this case Employer's contribution is more and the Employee's contribution as usual.
Is it permissible or any obligations from PF authorities. Please clarify.

One of the Manufacturing unit has running heavy losses the management has merger with another big firm, the firm has issuing on their name new appointment letters are issued without obstructing their contineouse service. Now while formulating the salary structure some are getting good increments some or less. Those who get less increment people are refused to collect the new appointment letter. In this jucture what are the laws we have to impose them weather termenat their services ??

Is it permissible if an employees BASIC salary reduced while formulating the increments ? If it is unavoidable situation, is there any case law not to reduces the current Basic salary ?

Sir,
Our company is a big manufacturing unit. We introduced 12CLs,12SL,&15ELs. The ELs as per the Factories Act. As we have approved leaves rules and as per that more than 60 days of ELs will be encashed in every Jan month before Pongal (Shankranthi) for all the employees. Now our management has changed they asked in which act it was adopted please show. As a HR-Manager I adopted these rules from the HL Kumar's Leave Rules book and the system is running since 12 years. Please give me your suggestion to over come this hurdel.
