Filled a written statement in a civil suit and won but my lawyer wrote some words which the plaintiff felt defamatery and filled a criminal complaint US 499 .
My question is filling a written statement is said to be publication of imputation .Y/N ?
Can u please refer me any sitation or case law or any judgements where filling a written statement is not said to be publication of imputation

Dear Anonymous,

It is purely a matter of interpretation alone - what is written and what is meant actually is totally a different things altogether and untill proved one has a right to say what he/she feels appropriate.
You are free to initiate any action but the only thing is whether you will be able to substantiate the same against the other party.
