Filled a written statement in a civil suit and won but my lawyer wrote some words which the plaintiff felt defamatery and filled a criminal complaint US 499 . My question is filling a written statement is said to be publication of imputation .Y/N ? Can u please refer me any sitation or case law or any judgements where filling a written statement is not said to be publication of imputation
It is purely a matter of interpretation alone - what is written and what is meant actually is totally a different things altogether and untill proved one has a right to say what he/she feels appropriate. You are free to initiate any action but the only thing is whether you will be able to substantiate the same against the other party. Best regards Daksh
