me, my brother , mother , brother in law res. in undevided family. we earn and spent all exp. jointly. we save money and then take property in the name of brother, mother because brother is main male mambers of our family, and mother is oldest member of our family.

HUF property is traditionally ancestral property being passed down the generations from father to sons/daughters and grandchildren. HUF comes into existence only upon complete partition. The type of transaction you are suggesting in your query is not HUF but a joint family property.

How could you prove that the assets belong to you as well when your name does not appear in the document of title ? How would your earnings be proved to havbe been contributed in the savings for the acquired property ? So long as the intentions are fair, you may get your name included as a joint owner of the property ? Who is the brother-in-law ?

In HUF the persons acquired right over the property by birth.But in your case you are only a spectator.
