In this public interest litigation it is alleged that a large number of
trees have been surrounded by concrete with the result that they are unable to
breath. It is submitted that de-concretization needs to take place.
It is a matter of common knowledge that there are thousands of threes in
Delhi. In fact, learned counsel for the Municipal Corporation of Delhi says
that a survey has been conducted in several zones and 9,395 trees have been
identified which need to be de-concretized. Out of these 5223 trees W.P.(C)
11162/2009 Page 1 of 2 have been
de-concretized.
Learned counsel for the NDMC also says that almost 80% of the trees in
the area within the jurisdiction of the NDMC had been de-concretized.
A similar stand has been taken by learned counsel for the Delhi
Government and the Delhi Development Authority.
Quite clearly, the exercise of de-concretization is quite massive and
cannot be done in a short while. Learned counsel for the NDMC says that in so
far as the area within the jurisdiction of the NDMC is concerned, de-
concretization will be completed by the end of May, 2010. Learned counsel for
the MCD says that the de-concretization will take another three months from
today.
The concerned authorities should continue with the process of de-
concretization and ensure that it is completed at least before the monsoon set
in.
With these observations and directions, the writ petition is disposed of.
