Another Civil Judge sitting in judgement over Decree

Querist : Anonymous (Querist) 17 April 2010 This query is : Resolved 
Partition Decree having attained finality over an year ago, how can another Civil Judge entertain a suit for declaration (in respect of such decreed property) by any non-joinder to that Decree ?

What steps could refrain this Another Civil Judge from even any inadvetant mis-carriage of justice ?

if the concerned judicial officer seems to be biased then either file a transfer application for transfer of your matter to another judge or make a complaint against him to the High Court.

Decree can be modified or altered by way of appeal. Better file preliminary decree as document in your favour

The suit can be filed to challenge the decree.If decree holders are not joined as party,it suffers from non joinder of necessary party,but you should apply tobe joined as party.
