Written Arguments

Querist : Anonymous (Querist) 13 April 2010 This query is : Resolved
Sir,

If the order goes against me in the transfer cmp in the HC what is the remedy...

1. Can I appeal to bench against the order of transfer cmp?
or

2. should I appeal to the supreme court as a SLP.?
or

is there any other remedy

3. in the high court for transfer cmp can I file written arguments?

You can adopt both the remedies viz. filing SLP or appeal before DB. Written arguments with the permission of the court can be filed.

whether the concerned High court allows appeal in such matters is a matter of rules and regulations being followed by it.

P&H high court does not allow any appeal or LPA in such cases, the option is to approach SC.

i dont think the HC bench will take on record written arguments, though on request all contentions will be recorded.

You have to challenge the order made in Tr.CMP in Supreme Court only
