Front lawn and car parking

Querist : Anonymous (Querist) 09 February 2022 This query is : Resolved
We built a railing/wall to divide our front lawn from the common passage and stairs as it was written in the registry that the front lawn belongs to the ground floor owner and because it was continuously being used by the first and second floor people in the past we had to build the wall/railing. Some new owners of the second floor have been mentally torturing us to break the wall/railing for their car parking. Is it illegal to construct a railing in our own front lawn as we have the proper right to use our verandah. ?
Also what action can be taken against someone who is mentally torturing us after we have been living peacefully for the last 20 years here. ??

How did you divide the front lawn from the common passage?

Hello,

As per query, the lawn belongs to ground floor owners. So the ground floor owners can restrict the other occupants. However, for further details consultation scrutinize the registered document and consult with local advocate. And take legal action accordingly.

Any suggestion depends upon the locally prevailing law governing ownership of apartments and land appertaining thereto. In this context, different States have different norms.

Is it a cooperative society apartment or some else ?
Does the subject ground / land constitute common area ?
Nothing can be presumed to oblige.

It's a 3 floor flats where each floor belongs to a different person/owner. The agreement clearly states that the front lawn belongs to us the ground floor owner. We live in district Faridabad Haryana and here every other building like ours has the same agreement and and every ground floor owner has restricted their areas with fencing or with other means. The second floor people have been mentally torturing us for just their one car parking which can easily be parked in the common passage.

Generally, in such cases, the developer provides for separate parking . As such, why this dispute?
