Filed case on march still no ws filed

Sir,
on March 2021 my advocate filed a case,but still now opposition has not filed single WS, only giving the excuses and extending the date after date.
can any thing be done.Please advice.

If the respondent is not filing his Written Statement the court can proceed with the case on its merit, as if he has nothing to say in the case.

There is time limit for filing the Written Statement. Normally it is 30 days but the maximum limit is 90 days. After that they can file it only with the permission of the court, based on specific request.

Though time limit is fixed to file w.s but if defendant shows sufficient cause for not filing w.s in time, court can grant more time or extend the time limit to file w.s.

Your advocate can urge the Court to direct the defendant to expedite the filing of Written Statement.

Hello,

Defendant has to file his ws within one month from the date of his appearance or service of summons. For filing the ws after one month he should have some valid reasons. Ask your advocate for proceeding no ws in your case.

Find out whether the local Bar association still following "No adverse order Resolution" or not. As in West Bengal we have "No adverse Resolution" till now! In case there is no adverse order resolution, by default next date will be allotted for submission of WS and will go on and on till the Bar resolution is not lifted. Aside please find out what is the current status of S/R or Appearance.
