Vacate the stay order

Hi Experts,

i have filed maintenance case against husband but he went to district court during the trial and obtained intrim stay order to avoid the maintenance still he is working and earning 1 lakh per month .he is impotent so he is just dragging the case from past 3 years.
Can i file vacate stay petition in district court or high court?

Stay obtained by your husband would be only Interim Stay and permanent stay will not be and should not be given with out hearing the other side,

Discuss with your Advocate and make efforts to vacate the stay. You should examine the Stay Order and petition to find out on what grounds the stay was given and with some valid objections the stay to be vacated please.

Move application in the District Court for setting aside stay order on the ground of delay in the process of Justice that is causing irreparable financial losses to you. If the Stay order on payment of maintenance is not allowed by District Court, you will have good ground for moving to the High Court.

You can expedite the proceedings in district court. So court will finally decide the appeal and pass appropriate maintenance order based on the income of husband.
